These terms govern your use of nngdigital.com.au. In these terms “we”, “us” and “our” mean Neural Networks Group Pty Ltd (ABN 53 691 933 632), and “you” means anyone using the site.

By using the site you accept these terms. If you do not accept them, please do not use it.

1. What this site is

This is the corporate website of Neural Networks Group Pty Ltd. Neural Networks Group Pty Ltd (ABN 53 691 933 632) owns and operates Ausvanta, Cognify Digital, Pulse Reach Digital and RANIA Academy. It is also developing Qably, shown on our Products page. This site describes the group and points to those brands’ own websites.

Nothing is sold on this site. No account can be opened here and no payment is taken here. Services and products are supplied under separate terms published on the relevant brand or product website, or under a written agreement signed for a particular engagement. Where those terms differ from these, those terms govern the supply and these terms govern only your use of this website.

2. The information on this site is general

What we publish here is general information about our group and what it does. It is not professional, technical, financial or legal advice, and it is not an offer capable of acceptance. Do not act on it in place of advice about your own circumstances.

We take care to keep the site accurate and current, but we do not promise that every page is free of error or up to date at the moment you read it. Prices, availability, service descriptions and product status can change.

3. Enquiries

Sending us an enquiry through this site does not create a contract or a client relationship, and does not oblige either of us to go further. We will use what you send us as described in our Privacy Policy.

Please do not send us confidential information through the enquiry form before we have agreed in writing to receive it.

The names Neural Networks Group, Cognify Digital, Pulse Reach Digital, RANIA Academy, Ausvanta and Qably, and their logos, are our trade marks. Nothing on this site gives you a licence to use them.

Third-party names and marks that appear on this site belong to their owners and are used only to identify them.

6. Links to other sites

This site links to our brand and product websites and to third-party sites. We do not control third-party sites and we are not responsible for their content, their accuracy or how they handle your information. A link is not an endorsement.

7. Availability

We do not promise the site will be available without interruption or free of faults. We may change, suspend or withdraw any part of it at any time, and we may do so without notice.

8. Liability

Our services and this website come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right you have under a law that cannot be excluded. This section applies only to the extent the law allows.

Subject to that, and to the extent permitted by law:

• we exclude all warranties, conditions and terms not set out in these terms;
• we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of data or loss of opportunity arising out of your use of this site; and
• where we are liable and the law permits us to limit that liability, our total liability arising out of your use of this site is limited to AUD 100.

Where a statutory guarantee applies and the law allows us to limit our liability for a failure to comply with it, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.

9. Indemnity

You indemnify us against any loss we suffer arising from your breach of these terms or your unlawful use of this site. This does not apply to the extent the loss was caused by us.

10. Changes to these terms

We may update these terms. The current version is always the one on this page, and the date at the top tells you when it last changed. Continuing to use the site after a change means you accept the updated terms. Changes are not retrospective.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.

13. General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, we do not give it up. These terms are the entire agreement between us about your use of this website.
